Terms of Use

These terms are an agreement between you and M94 Games, a brand of Arba Wa Tisoon Trading Establishment (مؤسسة اربع وتسعون التجارية), 6234 Al Olaya St, Al Woroud Dist., Riyadh 12215-2993, Kingdom of Saudi Arabia (“we”, “us”), for the game NEON SURGE: Hero Swarm (“the game”). By installing or playing the game you accept them. Our Privacy Policy explains how the game handles data.

1. Who can play

The game is rated for ages 13 and up. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you and is responsible for any purchases you make.

2. Your license

We give you a personal, limited, non-exclusive, non-transferable and revocable license to play the game on devices you own or control, for your own non-commercial entertainment. You may not copy, sell, rent, modify, reverse engineer or redistribute the game, or use cheats, automation or unauthorized software with it, except where the law allows this despite these terms.

3. Virtual items

Gems, Gold, Steel, Core, Dust, keys, shards, heroes, weapons, cards, gear and other virtual items are a license to use content inside the game. They have no value outside the game and cannot be exchanged for real money, sold or transferred. Gems you buy do not expire. We may change how the game and its items work, for example to balance it, as long as we do not take away items you paid for.

4. Purchases

• All purchases are made through the Apple App Store or Google Play, and their terms and refund policies apply. Prices are shown by the store in your local currency.
• Except where the law or the store’s policy says otherwise, purchases are final. If an item does not arrive, contact us.
• VIP and Season Passes can be restored through the store. Your progress and consumable items, such as Gems, are saved only on your device: if the device or the game’s data is lost, we cannot restore them.

5. Random items

The Hero Chest, card packs and the gear chest give random results. The odds of each result, and any guarantee, are shown in the game before each purchase or opening.

6. VIP subscription

• VIP is a monthly subscription at the price shown before you buy. Its benefits are listed in the game.
• Payment is charged to your Apple or Google account when you confirm the purchase.
• It renews automatically each month unless you cancel at least 24 hours before the current period ends, and the renewal is charged within the 24 hours before the period ends.
• Manage or cancel it in your store account settings (the game links to them). After you cancel, VIP stays active until the end of the period you paid for.

7. Season Pass

Each season lasts for the period shown in the game. The premium track you buy applies only to that season and unlocks every level you have reached, including those reached before you bought it. When a season ends, rewards you earned but did not claim are added to your account automatically.

8. Rewarded ads

Watching ads is always optional. A reward is given after the ad is completed, ads may not always be available, and some rewards have daily limits.

9. Fair play

Do not exploit bugs, change the device clock or edit saved data to gain rewards, or use tools that change how the game works. If you do, we may remove what was gained that way.

10. Changes to the game

We may update, change or stop features of the game. Features that rely on online services, such as purchases, ads and server settings, may sometimes be unavailable. If we stop offering the game, we will give notice in the game or on this site when reasonably possible.

11. Ownership

The game and its content belong to M94 Games or its licensors. Third-party content used under license is credited in the game’s Settings.

12. Disclaimer and limitation of liability

To the extent the law allows, the game is provided “as is”, without a promise that it will be error-free or always available, and we are not liable for indirect or consequential losses. Our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

13. Governing law

These terms are governed by the laws of the Kingdom of Saudi Arabia, and disputes go to the competent courts there, without affecting mandatory protections you have under the laws of the country where you live. These terms are published in Arabic and English; if the two versions differ, the Arabic version prevails.

14. Changes to these terms

We may update these terms and will change the date at the top when we do. For important changes we will tell you in the game. If you keep playing after a change, the updated terms apply.

16. Additional terms for the Apple App Store

If you got the game from the Apple App Store:

• These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the game and its content.
• Your license lets you use the game on Apple-branded devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, including through Family Sharing where it applies.
• We, not Apple, are solely responsible for maintenance and support of the game. Apple has no obligation to provide any maintenance or support for it.
• We are responsible for any product warranty that the law does not allow to be excluded. If the game fails to meet such a warranty, you may notify Apple, and Apple will refund the price you paid for it. To the extent the law allows, Apple has no other warranty obligation for the game.
• We, not Apple, are responsible for addressing any claims by you or a third party about the game or your use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection, privacy or similar claims.
• If a third party claims that the game or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must follow applicable third-party terms when using the game, such as your wireless data service agreement.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
